Birmingham Real Estate Attorney Succeeds in Preventing the Creation of a New Local Historic District
WWRP real estate attorney, John D. Gaber, recently made a compelling case to persuade the Mt. Clemens City Commission to reject a motion to designate a new historic district within the city. Despite opposition from the local historic community, Mr. Gaber successfully convinced the City Commission not to infringe upon the property rights of the property owner, or limit the property owner's flexibility to utilize those portions of its property proposed to be designated as an historic district.
The property proposed to be designated was the St. Joseph Sanitarium, Bath House and Hospital, built in 1899. This facility contains the last existing bath house that was such an important part of the heritage of Mt. Clemens. The facility was also a long-standing sanitarium and hospital, serving the community for many decades. While the portion of the facility proposed to be designated is mostly vacant, Select Medical Corporation, the property owner, operates a long-term acute care hospital in the newer buildings on the property. The City Commission agreed that it should not impose any costly restrictions on the property that could adversely affect the operations of the property owner, despite the significant historical value of the facility to the community.
